<p>3.	Minutes of the last meeting (12 March 2013)<br />

The minutes of the last Planning Committee meeting on 12 March 2013 were approved and signed as correct.  Proposed by Cllr Stokes, seconded by Cllr Shand.  All in favour (7).  Cllr Burtenshaw was not present at this meeting so she did not vote.</p>
<p>4.	Matters arising.<br />
13/44P</p>
<p>12/29P – Ellingham Quarry HCC &amp; NFDC 11/98107.  Fay Eames advised deed of variation being negotiated for s.106 with Tarmac with restoration date of 31-12-16.  The permissive path will be created in the final stages of the restoration.</p>
<p>12/95P &#8211; TPOs within parish.  Two sets of plans for TPO 1094.  The tree team have advised Clerk both TPOs have been incorrectly issued with same number, and they will be reviewed in due course when resources are available.  Clerk chased a response on 8-4-12.</p>
<p>12/113P &#8211; Projector &amp; Screen at Ellingham Church Hall.  Cllr Errington has met with Terry Mason to discuss the need for black out blinds and the projector screen to be sited in front of the large landscape window.  Terry will revert with a cost indication, and Cllr Errington has suggested the the Parish Council contribute to the cost.</p>
<p>12/175P Adlams Plantation.  Clerk has sent request for this wood to be TPO’d.  Liz Beckett advised she has liaised with Rosemary Box and this wood is within a s.106 stating the wood needs to be managed for a period of 80 years by systematic thinning and removal of Turkey oaks.  When it is finalised, Liz will review the s.106 and advise the clerk her opinion. Clerk chased a response on 8-4-12.</p>
<p>12/204P Dragon’s teeth Moyles Court ford area.  The work has been completed!</p>
<p>13/20P QU/13/0008 Horseshoe Cottage, Rockford – unauthorised development; retrospective planning application on agenda.</p>
<p>13/24P T&amp;PC’s ‘Right to reply’ at NPA meetings. The Clerk circulated Steve Avery’s response on 11 March – it is being proposed for Town &amp; Parish Councils to have 1 minute Right to Reply but no change to current unlimited time for initial presentations.  It will go before the NPA’s meeting on 28 March for approval.  Awaiting update from NPA.</p>
<p>13/32P<br />
The Parish Council’s proposal to display a ‘no parking’ sign on Moyles Court ford gate with landowner Mr Smith’s permission, however Mr Smith has responded that he doesn’t think it would help. Cost of sign approx £20.</p>
<p>13/40P<br />
Consultation on the NPA draft Local Enforcement Plan – on agenda.</p>
<p>NPA 13/98209 Land at Mockbeggar, Moyles Court, Rockford – application for Certificate of Lawful Development for existing use of land for agricultural purposes.<br />
Cllr Spark updated the members of the Planning Committee, clarifying it is a Lawful Development Certificate (LDC) application, not a conventional planning application.  He apologies for the delay in the Parish Council’s response to the NPA; this was due to clarification being sought on planning issues.  Cllr Spark proposed for the Parish Council’s formal response on this LDC application to be as follows:-</p>
<p>“If the NPA are minded to grant the LDC, the Parish Council understand that the use of land for grazing of horses does constitute a lawful agricultural use, as applied for in this application 13/98209.”</p>
<p>Cllr Burtenshaw enquired if it would be possible to ask the NPA when they are determining their application, what number of horses they recommend would be acceptable as ‘grazing’ within the defined agricultural use of the land.</p>
<p>The formal response proposed by Cllr Spark, seconded by Cllr Richardson, 7 in favour, 1 abstention.  Clerk to make response to NPA.</p>
<p>5.	Public Forum – none.</p>
<p>6.	Development control and TPO applications.<br />
Please note: the applications are recorded in the order that they were discussed, not as per the agenda.</p>
<p>13/45P<br />
NPA 13/98216 Moyles Court School, Rockford – replacement outbuilding; demolition of existing outbuilding; boundary wall repairs.  Cllr Errington detailed the location of the proposed structure, which is to house a new bio mass boiler which uses wood chips to heat water for heating.</p>
<p>Cllr Spark declared a non-pecuniary interest as his daughter attends the school.</p>
<p>Cllr Errington showed where it is proposed to be sited on an aerial plan and photos of the current site and structures.  The existing outbuilding (height 2.5m) will be replaced with a timber clad outbuilding (height 4m); two oil tanks to remain.  The proposed structure would be close to a wall (height approx 1.1m) which is listed by association with the main house.  The proposed outbuilding needs to be 4m high to accommodate the large storage volume required for the wood chip store and the accumulation tank (height 3.5m) which stores the heated water; it requires no foundations as it is built on reinforced slabs.</p>
<p>A member of the public raised concerns on; close proximity of new outbuilding to the listed wall; not being consulted as the adjoining landowner; the potential fire risk; and whether a flue is required, as it is not shown on the drawing or within the application.  The architect responded that the adjoining landowner would be consulted at a later date under the Party Wall etc Act 1996 as part of the building regulations, and he apologised on behalf of the School that the landowner had not been directly advised of the planning application.  The architect then confirmed that the flue height is 2m above the roof height and would be supported by two metal structural stays, which would result in the total height of the flue being 6m.</p>
<p>The potential of emissions affecting neighbouring properties and the visual impact were discussed, in addition to any potential impact on the listed wall.<br />
Cllr Richardson proposed option 5, which is to accept the decision reached by the NPA’s officers under their delegated powers with the following comments:-<br />
The Parish Council was concerned that the application lacked sufficient information to make a proper recommendation. There was no flue for the biomass boiler on the drawings and we were advised by the applicants architect that this would extend, with support stays, to 6m above ground thus protruding 2m above the building. In addition it is 300mm in diameter and would be visually significant.<br />
In addition there was no direct scaled comparison of the existing shed with the proposed building but it is apparent that the new building would be forward of the listed wall.<br />
The Parish Council has concerns on:-<br />
•	the visual impact of the structure is significantly more massive compared to the existing and adjoining properties, the 6m height of the flue (not included within the drawings or application) and the consequence of emissions;<br />
•	any impact on the adjacent listed wall.</p>
<p>Seconded by Cllr Stokes, all in favour (8).</p>
<p>13/46P<br />
NPA 13/98289 Little Patch, 5 New Road, Mockbeggar – detached outbuilding.  Cllr Shand explained the location of the property and showed photos of it and the two nearby footpaths.  The proposal is for demolition of the existing garage and creation of a new outbuilding.  The outbuilding would be situated just over 1m from the property’s boundary and one of the footpaths is approx. 4m the other side of this boundary.  The applicant detailed that advice was taken from the NPA and the new outbuilding is situated outside the root protection zone.  The materials to be used will match the existing property; black timber-clad and slate roof and approx. 7m x 4m.<br />
Cllr Burtenshaw proposed to recommend permission under option 3, with the following reasons; the proposed outbuilding fits well into the existing landscape and is not intrusive on the plot; EHI PC would request the applicant take steps to help attenuate the potential light pollution with installation of blinds.<br />
Seconded by Cllr Shand, all in favour (8).<br />
13/47P<br />
NPA 13/98299 Horseshoe Cottage, Rockford – retention of boundary wall &amp; fencing.  Cllr Richardson explained the location and showed photos of the property before and after the works carried out to the front boundary; it was previously a picket fence, and now the new red brick pillar and picket fence structure is significantly higher than the original gate and appears to be built in front of the previous boundary, resulting in it encroaching on the verge.</p>
<p>The applicant apologised as he was unaware of the need for planning permission; he wanted to protect his grandchildren from the fast road and livestock hanging over the fence.</p>
<p>It was discussed at length and agreed that rather than the whole structure be taken down, the Parish Council would be happy with some modifications to the wall, such as a reduction in the pillar height and removal/toning down of the urban white pillar caps.  It was noted that the wall does match the style of the house.  Advice was also given to the applicant on reducing light pollution.</p>
<p>Cllr Richardson proposed to recommend refusal under option 2 with delegated powers to the NPA for the following reasons:-</p>
<p>The Parish Council felt the wall is not in keeping with its’ rural forest environment, however would accept measures to improve its’ visual impact:-<br />
•	the capping stones on the pillars to be more muted in colour, ie not white;<br />
•	the height of the pillars to be reduced to make it commensurate with its’ neighbouring properties and the original fence it replaces.</p>
<p>Seconded by Cllr Shand, 7 in favour, 1 abstention.  Motion carried.</p>
<p>13/48P<br />
NPA 13/98320 Alice Lisle Inn, Rockford – replacement lobby (demolition of existing lobby) &amp; NPA 13/98321 Alice Lisle Inn, Rockford – replacement lobby (application for Listed Building Consent) These applications will be discussed together.</p>
<p>Cllr Lane explained the location of the building and detailed where the proposed works are to be carried out; replacing the lobby at the back of the building near the toilets.  The plans were examined and concerns were raised over the proposed addition of the large ‘L’ shaped pergola extending from the new lobby and round the building over the outdoor seating area.  It was agreed that such a structure would put the listed building totally out of balance and could create a potential for the structure to be infilled in the future.</p>
<p>Cllr Spark proposed to recommend refusal under option 4, for the following reasons:-</p>
<p>•	the proposed pergola would exacerbate the imbalance with the listed building;<br />
•	the Parish Council are concerned the pergola could be infilled in the future.</p>
<p>Seconded by Cllr Errington, all in favour (8).</p>
<p>As Cllr Lane needed to leave the meeting early, agenda item 9 was brought forward by the Chairman.</p>
<p>9.	Consultations;<br />
13/49P<br />
NPA Draft Local Enforcement Plan – response by Cllr Lane) response deadline 12 April).<br />
Cllr Lane advised she felt the Plan very clearly sets out what the enforcement team will be able to so, and she feels no further comment is required by EHI PC.  Cllr Errington had also looked at the Plan, and requested permission for him to send some minor comments to the NPA.  Proposed by Cllr Lane, seconded by Cllr Spark, all in favour (8).</p>
<p>Cllrs Burtenshaw and Lane left the meeting at 9.10pm.</p>
<p>Continuation of agenda item 6. Development and Control and TPO applications:</p>
<p>13/50P<br />
NFDC 13/10255 Blashford Manor, Salisbury Road, Blashford – Use of former barns as 4 holiday lets (Use Class C1); bin &amp; cycle store; assoc. parking; widen existing access.  Cllr Errington explained the location and showed the area to be converted to holiday lets on the aerial plans.  In the previous application, car parking was proposed on agricultural land, however in this application the parking will be brought internally within the piggeries/stables.<br />
When reviewing the widening of the access proposals, it was noted that this area was not shown on the site plan (actually, not bounded by a red line, which delineates the area(s) for development).  Cllr Errington explained there are currently two entrances to the A338; it is proposed for the southern entry to be infilled and the northern entry to be widening to accommodate ‘in and ‘out’ traffic movements.</p>
<p>The proposed holiday lets accommodation is identical to the previous application, on an existing footprint and materials are to be reused wherever possible.  It would result in a relatively low impact building.</p>
<p>Concerns were raised on the potential promotion of stabling of visitors’ horses (in existing stables) alongside the holiday lets business, as exiting onto the very busy A338 on the inside of a bend could be extremely dangerous, either on foot or with slow horse boxes on an unfamiliar road.  All agreed that Hampshire Highways need to be thoroughly consulted.</p>
<p>Cllr Spark proposed to recommend permission under option 1 with the following comments:-</p>
<p>•	The Parish Council has serious concerns in relation to the access onto the main road (A338), and would request that Hampshire Highways are fully consulted for their endorsement;<br />
•	These proposals are an improvement to the previous application;<br />
•	The Parish Council would recommend enquiries to be made in relation to what landscape proposals are put forward by the applicant.</p>
<p>Seconded by Cllr Richardson, 5 in favour, 1 abstention.</p>
<p>13/51P<br />
NPA 13/98258 McDonald’s Restaurant Ltd – illuminated &amp; non-illuminated signage.  Cllr Richardson explained the location and showed the proposals of two signs to be mounted on the south-facing roof of the building, which would be visible only from the entrance to the site; an illuminated ‘M’ and an illuminated ‘McDonalds’.  Concern was raised about why there are no details of the times they would be illuminated.  It was noted that the site in situated within the New Forest National Park and the environmental zone is classified as E1-intrinsically dark skies.<br />
Cllr Spark proposed to recommend refusal under option 4, for the following reasons; illumination of the signs considered unnecessary; no details of the intensity level of illumination and times of illumination.  Seconded by Cllr Shand, 5 in favour, 1 against.<br />
&#8216;Information received subsequent to the meeting suggests that the advised 600 cd/sq.m. generated light output from these signs is excessive.  Regardless of site screening, a figure of 100 cd/sq.m. would be more appropriate in this sensitive location, a light output that would still create sufficient conspicuity to adequately advertise the corporate branding.&#8217;<br />
13/52P<br />
NPA 13/98259 McDonald’s Restaurant Ltd – various illuminated &amp; non-illuminated signage associated with drive-through.  Cllr Richardson explained the location and showed the proposals of the Department of Transport traffic and other drive-thru related signs proposed around the site.  Concerns were raised about the number of signs and questioned whether all are necessary.  Many of the signs are of a large size and illuminated, but there are no details of the intensity level of illumination and times they would be illuminated.  As with 13/95258, it was noted that the site in situated within the New Forest National Park and the environmental zone is classified as E1-intrinsically dark skies.<br />
Cllr Spark proposed to recommend refusal under option 4, for the following reasons; the level of signage is considered excessive; illumination of many signs is considered unnecessary; no details are included of the intensity level of illumination and times they would be illuminated. Seconded by Cllr Stokes, 5 in favour, 1 against.<br />
13/53P<br />
NPA 13/98270 McDonald’s Restaurant Ltd – change of use from A3 to A3/A5 (rest.&amp;takeaway) ; refurbishment of restaurant; installation of drive-thru lane &amp; associated works; installation of customer order display &amp; canopy.  Cllr Richardson explained the location and showed the proposals of the other drive-thru around the site, using existing tarmac except behind the property where a new tarmac would have to be laid to create the drive-thru close to the boundary onto the National Park.</p>
<p>This was extensively discussed and the following concerns were raised:-</p>
<p>•	The substantial increase in traffic to/from the site that the drive-thru would create.<br />
This is estimated by the agent at 100 cars per hour, or an additional 200 vehicle movements/hr.  This confined area, including the neighbouring Shell filling station, is accessible from a very busy trunk road (A31) and to traffic using the road to/from Burley.  The area already has traffic safety issues due to the extent of parking on the verges of the slip road around the Shell station (HGVs on rest periods and Shell staff(?));<br />
•	The increased number of visitors to this area.<br />
It is highly likely this will exacerbate the extent of verge parking, resulting in poorer sight-lines for cars entering/leaving the site and garage, as well as for through traffic on the slip road;<br />
•	Sight-line to the west for vehicles exiting the site.<br />
Drivers&#8217; visibility to the west is very limited by the Shell station’s totem near to the edge of the highway, which severely impacts the safety on exiting the site;<br />
•	The impact on the root areas of the tree line on the northern boundary due to the proposed roadway at the rear of the building;<br />
•	The potential for takeaways to be consumed away from the site in nearby Forestry Commission car parks and in transit on surrounding B/C roads and the A31.<br />
This would likely result in litter being disposed of where it could harm livestock and be a cause a considerable public nuisance;<br />
•	Details of trading hours of the restaurant and take-away not being included in the application.</p>
<p>Cllr Spark recommended refusal under option 4 for the following reasons:-</p>
<p>The Parish Council feel very strongly that this application raises serious issues about:</p>
<p>•	the impact of the increase in traffic levels and congestion in the area (advised at up to 200 vehicle movements/hr);<br />
•	the narrow visibility splays and relatively narrow width of the site entrance, particularly its suitability for articulated and other large truck deliveries;<br />
•	traffic safety for vehicles exiting the site due to very limited sight line to the west caused by the position of the Shell service station totem;<br />
•	traffic safety arising from the current level of verge parking in the vicinity, and being exacerbated by the increase in visitors to site and McDonald&#8217;s staff parking &#8211; The Parish Council would like the current parking practice to be investigated by Highways and any other necessary agencies to advise land ownership, and whether it is appropriate and safe;<br />
•	the likelihood of drive-thru customers consuming meals in nearby Forestry Commission car parks or in transit on surrounding B/C roads and A31 &#8211; This will very probably generate additional litter problems, as well as a hazard to greedy New Forest stock!  Although a litter control regime is described (section 4 Planning Statement) the Parish Council would like a comprehensive litter pick/inspection scheme of the site and surrounding areas to be conditioned if possible;<br />
•	the impact on the root-hair systems of the trees on the north of site &#8211; Despite the extensive protection and mitigation measures advised, it is thought that re-profiling of the ground for the proposed road behind the building will be required; it would have been helpful to have had north/south sections along the proposed roadway area;<br />
•	whether there is sufficient tree screening around the site;<br />
•	the extent of lighting in the car park and circulation areas &#8211; 10 no. indicative 6m columns with 11 no. luminaires were identified on the proposed Site Plan, but without descriptions of fittings or lux outputs.  It is important that these be specified in order to assess the impact of the scheme and, taken together with the other external lighting proposals, their potential combined contribution to light pollution in this area;<br />
•	the trading hours &#8211; The Application form advises ‘not known’ (Section 20), while the Planning / D&amp;A Statements refer to 24hr operation at other sites as being common.  This issue also impacts on the above consideration.</p>
<p>Seconded by Cllr Webster, all in favour (6).</p>

13/55P<br />
Appeal: NPA 12/97697 Red Shoot Camping Park, Linwood – change of use of building to create 1 unit of holiday accommodation.<br />
As Cllr Spark had declared a non-pecuniary interest in this item, he asked Cllr Errington to chair this agenda item.<br />
Cllr Errington outlined for the Planning Committee the planning application and EHI PC’s response (meeting on 14 August 2012), highlighting concerns that permitting a self-catering holiday unit might inadvertently create an independent dwelling in planning terms.  He detailed there are approx. 10 Forestry Commission and 10 private camping and caravanning sites within the New Forest, and they are intended to be low-key sites with little or no infrastructure.  Also, it is not known whether an Unilateral Undertaking, volunteered by the applicant to condition the use of the building, can be overturned, if so it could result in a new dwelling being created within the New Forest.</p>
<p>It was discussed and agreed by all that the previous comments submitted following 14 August 2012 will remain as EHI PC’s response.</p>
<p>Cllr Spark took back the role of Chairman.</p>
<p>13/56P<br />
Enforcement: Forest Corner/Korna, Mockbeggar – complaint received concerning decking.  Details of the potential breach to be forwarded to all members.  Clerk to do.</p>
<p>9.	Consultations: brought forward and discussed under minute number 13/49P.</p>
<p>10.	Discuss and consider application for bridge across ditch on EHI owned verge at Cross Lanes<br />
13/57P<br />
With the applicant’s agreement, this item has been deferred to 14 May 2013.  Clerk to put on the agenda for 14 May 2013.</p>
<p>11.	Discuss NFDC’s conditions on licensing application Shell Forest Edge A31 Eastbound<br />
13/58P<br />
The Clerk outlined the next steps, which are for this licensing application to be heard by a licensing panel and EHI PC would need someone to attend to present the Parish Council’s representations.  It was agreed for the Clerk to seek advice on why our concerns of 24 hour licensing are not considered an issue.  Clerk to action.</p>
<p>Note: following the meeting notification was received from the Licensing Panel advising 2 of our 4 poinys raised objecting to the license were irrelevant.  So with the Chair &amp; Vice Chair’s agreement, the Clerk advised that the Parish Council has withdrawn their comments.</p>
<p>12.	Correspondence<br />

The Clerk had been notified of a consultation on the NPA draft Landscape Action Plan and Landscape Character Assessment consultation, which requires a response by 13 May (circ.8Apr13).  Cllr Stokes volunteered to look at this consultation and circulate a proposed response.</p>

New Forest Community Routes.  Cllr Richardson volunteered to look at a project to record routes within the parish on maps.</p>

Cllr Webster raised concerns where trees are showing signs of ringbarking the trees are not fenced to protect them from stock.  Clerk to liaise with the owner.</p>

There had been email correspondence between the members in relation to a field being advertised to be sold as four pony paddocks on Snails Lane.  It was noted that according to the estate agent, two parcels had already been sold.</p>

<p>NOTICE IS HEREBY GIVEN under Section 14 of the Road Traffic Regulation Act 1984 (as amended) that New Forest District Council, acting as agent to the Traffic Authority, Hampshire County Council, owing to works in connection with ford repairs considers that the closure to the road as specified below should come into force without delay:</p>
<p>ROAD TO BE CLOSED: That length of C159 Gorley Road Ringwood, between its junction with Northfield Road and its junction with Ellingham Drove.</p>
<p>ALTERNATIVE ROUTE:<span id="more-359"></span></p>
<p>From the northern point of closure, west via Ellingham Drove to its junction with A338 Salisbury Road; south via Salisbury Road to its junction with Northfield Road; east via Northfield Road to the southern point of closure and vice versa.</p>
<p>PERIOD OF CLOSURE: From 7th May 2013 for a period of five days or until completion of the works whichever is sooner. (Notwithstanding the above it is expected that the closure will be required for no longer than 4 days between 0900hrs and 1530hrs only on each day)</p>
<p>Reasonable facilities will be provided to allow access to adjacent premises while the work is being carried out.</p>

				<content:encoded><![CDATA[<p><span style="font-style:inherit;line-height:1.625;">The County Council installed the original barrier scheme around the ford at Moyles Court nearly ten years ago to stop vehicles parking all over the SSSI designated verges; it was also intended to separate the cars from where people picnicked and played around the stream. However, from the outset, the low barriers were prone to breaking and being knocked out of the ground, particularly when up against a sturdy vehicle!<span id="more-330"></span></span></p>
<p>Due to the wear and tear the cost of repairs has increased year on year, and the Parish <a href="http://ehipc.files.wordpress.com/2013/04/20140214-_2140104.jpg"><img class="alignright size-medium wp-image-343" alt="OLYMPUS DIGITAL CAMERA" src="http://ehipc.files.wordpress.com/2013/04/20140214-_2140104.jpg?w=300&#038;h=225" width="300" height="225" /></a>Council felt the time had come when it would be more cost-effective to replace everything, and take the opportunity to improve the layout and make it look more like other New Forest parking and protection schemes. With the help of a generous grant from the Hanson Concrete Charitable Trust, we have now been able to do it.</p>
<p>Having agreed with Natural England and the National Park Authority that a radical re-design of the parking areas would not appropriate, at first glance it may look as if the barriers have just been replaced by <a href="http://ehipc.files.wordpress.com/2013/04/20140214-_2140115.jpg"><img class="alignright size-medium wp-image-345" alt="OLYMPUS DIGITAL CAMERA" src="http://ehipc.files.wordpress.com/2013/04/20140214-_2140115.jpg?w=300&#038;h=225" width="300" height="225" /></a>dragons&#8217; teeth. However, all the bays are now slightly larger, to take account of cars having got a bit bigger in the last ten years; the splays have been re-shaped to make it easier to get in and reverse out; and adding more posts with high-level reflective markers is intended to take the guesswork out of where the teeth are.</p>
<p>The verge barriers opposite Moyles Court School, and round the corner into Ellingham Drove, have been removed and replaced by a ditch and bank divider. This will very quickly start to grass over as the seedbed was left in situ, so by next year should all be returning to green. To the south of Dockens Water, dragons&#8217; teeth have replaced the barriers.</p>
<p>The final phase of the works will be to resurface the worn out and heavily pot-holed parking areas with local hoggin.<br /> Our thanks to Gary North and his team at the Forestry Commission for the quality of the finished scheme and the incredible speed they carried out the makeover. Compared with the weeks of negotiation and getting approval that went into the planning, putting it all in place took just a few hours!<br /> Cllr Errington</p>

<p>Queen’s Diamond Jubilee<br />
One of the trees has been planted at Harbridge Green by Cllr Stokes, many thanks to him for planting and fencing the tree – photos shown. A second suitable site is still to be found.</p>
<p>Website<br />
The volunteer Richard Loader has made some excellent additions to the website, such as a Parish Events page and a Parish News page &#8211; please take a look and email any further suggestions to the Clerk. Cllr Spark will be arranging a meeting with Richard to discuss his proposals for the website.</p>
<p>Moyles Court Barriers/Dragons Teeth<br />
The revised detailed plan has been approved by Natural England and the Forestry Commission plan to commence the works the week of 25 March. Hanson Trust has agreed to a grant in principle, awaiting their confirmation. Once full consent and funding is in place, the Clerk will advise Moyles Court School and Newlands Farm of the proposed works.</p>
<p>Headlands 106 Monies.<br />
An update and explanation about the available funds is awaited from Martin Devine. Cllr Errington to chase.</p>
<p>Forest Fit Club/ National Trust.<br />
Michelle Baxter has confirmed issuance of a 6 month licence to Forest Fit Club, which is restricted to use of the commons twice a day (they previously had 3 activities a day). The NT will be monitoring the use by this club, and will review it at the end of the term.</p>
<p>Proposed amendments to Standing Orders.<br />
These are still under review By Cllr Burtenshaw and will be circulated in due course.</p>
<p>Fishing Rights on Local Lakes (12/233)<br />
DCllr Dow has investigated this matter with Chris Elliott, who has asked Somerley Estate to submit a Lawful Development Certificate application.</p>
<p>Environmental Matters<br />
-Parish Projects for Blashford Lakes Access Forum / Access Forum has met today – this will be discussed when Sam Jones speaks later in the meeting.</p>
<p>-Paths for Communities Grant Scheme<br />
Cllr Webster is investigating applying for grant funds to link the path/cycle way by the A338 at Ivy Lane junction to the permissive path by Ellingham Lake. Potentially an application could be put in to the Paths For Communities grant scheme.</p>
<p>-Motor Cycle Trials – Effect on Footpaths<br />
Cllr Burtenshaw was emailing Somerley to raise concerns about condition of footpaths used in motor cycle trials and suggesting future events in February and November access the site via CEMEX entrance.</p>
<p>-Schedule of Maintenance<br />
Updated schedule has been circulated and will continue to be done on a regular basis. The flailing has been carried out on the Gorley Road.</p>
<p>-Dockens Water – Fallen Debris<br />
A response is awaited from Wessex Water.</p>
<p>-Cross Lanes Verge protection (Small Fleabane)<br />
This is another ongoing project to protect the verges in the Cross lanes vicinity. There will need to be detailed plans and consultation with nearby residents plus formal consent from Natural England before the matter can be actioned. It will remain on the agenda.</p>
<p>-Brambles at Moyles Court to Cross Lanes<br />
Tom Hordle has successfully completed the work to remove brambles from Moyles Court ford to Cross Lanes.</p>
<p>-Mockbeggar Lane East Dragon’s Teeth<br />
Larger logs are to be installed to protect the verges as an alternative to permanent dragon’s teeth (pending a conclusion to other outstanding action by Newlands Farm).</p>
<p>-Ditch and Culvert standard response.<br />
This is retained as an ‘ongoing item’ but amendments may need to be considered in the light of our further discussions on flooding etc. The handyman Terry Mason has been instructed to monitor the ditch north of Ibsley Service Station to try and keep it clear to help minimise flooding. CCllr Heron advised there is no vacancy on the Lengthsman Scheme at present; it will be reviewed in August. Clerk to write to Cllr Mel Kendal advising EHI would be keen to join.</p>
<p>-Manure pile, Mockbeggar<br />
This has been moved a significant distance away from the ditch to prevent any leaching into the watercourse.</p>
<p>-Proposal of National Trust Local Guided Walk.<br />
This has been moved to 20 April 2013 and times of the walks will be issued beforehand. Please can I encourage as many Councillors as possible to attend.</p>
<p>Increasing number of Councillors<br />
Clerk is liaising with NFDC on this matter and will update in due course.</p>
<p>Guest speaker for Annual Parish Meeting<br />
Lee Hulin, NT Outdoors Ranger has agreed to be the Guest Speaker this year.</p>

iii. Discussion of proposal for Chairman’s technology contribution (circ.11Feb13)<br />
Cllr Lane had circulated her proposal for a payment of £350 (subject to budget availability) to be made to Cllr Burtenshaw in order for her to purchase suitable mobile technology to assist her in her role as Chairman and roving ambassador of the Parish Council. It was clarified that the proposal is for the equipment to be owned by Cllr Burtenshaw, not the Parish Council. The proposal was proposed by Cllr Stokes and seconded by Cllr Shand, all in favour. CCllr Heron advised the Clerk should firstly investigate this with the NFDC Monitoring Officer before completing the payment.</p>

iv. Approval of precept request to NFDC for 2013/14 (circ.20Feb13)<br />
The Clerk had circulated the precept request and confirmed the grants to the Parish Council had been agreed on 25 Feb’13 as a total of £600 (as expected). Therefore Cllr Lane proposed to approve the precept request for 2013/14 as £19,175. Seconded by Cllr Richardson, all in favour. Clerk to advise NFDC.</p>

v. Grant application Jubilee Sailing Trust (circ.30Jan13)<br />
The grant application received from the Jubilee Sailing Trust was discussed and all agreed that any grants issued should be for local concerns and have a direct connection with the Parish. On this occasion no grant was awarded. Cllr Stokes will formerly put in a proposal for 26 March for a grant to a local sailing club.</p>
<p>7. Question &amp; Answer session with Sam Jones, Area Countryside Access Manager – South<br />
13/30<br />
Cllr Lane welcomed Sam Jones to the meeting, who had kindly volunteered to attend to discuss some issues with the Newlands Bridge at Linwood Bog and also summarise the discussions and any decisions from the Blashford Lakes Access Forum meeting (which had taken place that morning).</p>
<p>Sam detailed how Linwood Bog is requires special protection for conservation reasons, and the Newlands Bridge crosses the bog and the footpath is used as a year round route. After extensive negotiations with Natural England and the National Trust, it was agreed the bridge be replaced with a single span structure for pedestrian use only, and it be in keeping with the natural environment.</p>
<p>Regrettably the self closing gates (at each end of the footbridge) to keep stock and horse riders off the bridge were repeatedly vandalised, causing damage to the bridge and found dumped nearby. After discussions with the Verderers, Agisters, Natural England, National Trust, and other relevant associations, it was agreed the gates were desirable but not essential. The footbridge is designed to take heavy loads associated with pedestrians and the occasional stock, not horse and rider, and should not be used for anything other than pedestrians.</p>
<p>The Equestrian Association decided to pursue their right to use this bridge, however it has since been determined that they do not have the right to use this bridge on horseback, as they initially perceived. CCllr Heron advised he had not had any issues raised directly with him on this matter.</p>
<p>The wood used had to be strong enough to support a large single span bridge, and whilst HCC Rights of Way try to use local suppliers wherever possible, the material used here are a type of African teak.</p>
<p>13/31<br />
Sam detailed the discussions at the Blashford Lakes Access Forum meeting that morning, which identified a list of potential projects which the attendees then prioritised and began to explore potential funding opportunities. Details as follows:-</p>
<p>• Extension to the cycle/pedestrian route north of Ivy Lane to link up cycle route and access gate to Blashford Lakes. HCC Highways require £7,000 for a feasibility study, and HWT have indicated they will allow access through the gate.<br />
• Access to the Wessex Water owned bridge, with Wessex Water accepting public liability ad infinitum, and the permanent diversion of FP703 over this bridge. Sam is to contact Wessex Water to try and finalise these discussions in the next two weeks, and agree a reasonable sum of money for their agreement to this.<br />
• A number of footpaths have been highlighted for improvements, 701, 718 and 703. Sam will look into costs for improvements and take it back to the working group to prioritise.</p>
<p>Sam advised there are many potential options of obtaining some funding for these projects, either via Paths for Communities or the Small Grants Scheme. These will be investigated by Sam, and he hopes to ‘get to work’ on these possibilities and spend the monies held by the Parish Council for improvements in the Blashford Lakes area.</p>
<p>Cllr Stokes raised concerns on the condition of FP23, and Sam advised that HCC ROW responsibilities are for the surfacing, ditching etc not the vegetation, as this is the responsibility of the adjoining landowner.</p>
<p>Sam encouraged that any questions to which he doesn’t have the answer immediately, to be put to the Clerk and she will forward them to Sam for a response. Sam will forward a statement of intent for the Clerk to be able to provide the auditor with, as EHI PC were criticised for holding a large credit balance.</p>
<p>8. Crime in the Parish – none.</p>
<p>9. Environmental Matters:<br />

i. Footpaths. Further to the Blashford Lakes Access Forum meeting earlier the same day, it was agreed for the Clerk to write to John Durnell (HIOWWT Head of Conservation – West Hampshire) once cleared with Fiona Bowles of Wessex Water. Cllr Errington will assist the Clerk with drafting a letter.</p>
<p>ii. Ditches, culverts &amp; overhanging vegetation: none.</p>

iii. Community Payback update. Cllr Lane advised the Clerk is asking for suggestions of where litter picking could take place within the Parish. Cllr Stokes mentioned the area between the bridges at Harbridge has litter following the flooding, however it was determined this is a 60mph limit – Clerk to enquire if this could be actioned by Community Payback. Cllr Richardson volunteered to review the Parish Council owned verges for litter. Clerk to allow Cllr Richardson access to verges maps.</p>
<p>10. Community Matters:<br />

i. Discuss HARAH report on Drop-In Event held on 20 Sep’12 (circ.21Jan13) and agree next steps. It was discussed and agreed by all that Mags Wylie should be approached for advice on what she recommends the next step for EHI to be. Clerk to do. The sites mentioned in her report were reviewed at the meeting. CCllr Heron advised he has observed there have been several parishes within Hampshire where successful affordable housing schemes have been implemented, and reiterated how important it is to ensure there is housing available for local people. He encouraged the Parish Council to continue investigating this project.</p>

ii. Ellingham Show 10 August 2013 – decide whether to attend. It was discussed and agreed the Parish Council would have a stand again this year; regrettably the Clerk will not be able to attend this year but she will ensure all is in order before taking her annual leave. CCllr Heron kindly offered to come along and be available on the stand for a couple of hours, which was gratefully received by the Parish Council. The working party was appointed as Cllrs Lane, Stokes, Webster and Richardson. Cllr Lane to organise the first meeting.</p>

CCllr Heron detailed there is lots of work being undertaken to try and repair the many potholes that have resulted from the wet, cold weather. Should any potholes have been missed in your area, please let Bob Brown know as the group working on them may have moved to another area. Have a look at the website to see if they are listed as known by HCC.</p>
<p>CCllr Heron talked about the main areas which are big costs that HCC fund, such as Adult Social Care and Child Protection. The Highways budget is just 3% of HCC’s overall funding for the community. He would like to attend a meeting after May and show some slides to the members before a meeting. Clerk to organise.</p>

DCllr Dow advised there will be a full council meeting at Lyndhurst to approve the precepts; he confirmed the district part of the Council Tax requirement has been frozen this year. There will be a rise in Council Tenants’ rates by 4.5%.</p>

The minutes of the last Planning Committee meeting on 12 February 2013 were approved and signed as correct. Proposed by Cllr Stokes, seconded by Cllr Webster. All in favour (7).</p>
<p>4. Matters arising.<br />
13/31P</p>
<p>12/29P – Ellingham Quarry HCC &amp; NFDC 11/98107. Clerk has spoken with Fay Eames; HCC are negotiating a deed of variation for s.106 with Tarmac. Fay will email clerk when final decision issued.<br />
12/95P &#8211; TPOs within parish. Two sets of plans for TPO 1094. The tree team have advised Clerk both TPOs have been incorrectly issued with same number, and they will be reviewed in due course when resources are available.</p>
<p>12/113P &#8211; Projector &amp; Screen at Ellingham Church Hall. Cllr Errington is hoping to meet with Terry Mason in the next few days, and will request for it to be on the agenda in due course.<br />
12/175P Adlams Plantation. Clerk has sent request for this wood to be TPO’d. Liz Beckett advised she has liaised with Rosemary Box and this wood is within a s.106 stating the wood needs to be managed for a period of 80 years by systematic thinning and removal of Turkey oaks. When it is finalised, Liz will review the s.106 and advise the clerk her opinion.<br />
12/204P Dragon’s teeth Moyles Court ford area. Natural England has given their consent for the works, the Clerk is liaising with Somerley Estate in relation to the works to verges owned by them. The grant has been approved by Hanson Concrete Charitable Trust. Works are scheduled for 25 March, the Clerk will advise adjoining landowners and erect notices to advise residents and visitors.</p>
<p>13/20P QU/13/0008 Horseshoe Cottage, Rockford – unauthorised development; front boundary wall &amp; driveway. The NPA are still investigating this enforcement, and have advised the Clerk each breach is reviewed individually.<br />
13/24P T&amp;PC’s ‘Right to reply’ at NPA meetings. The Clerk circulated Steve Avery’s response on 11 March – it is being proposed for Town &amp; Parish Councils to have 1 minute Right to Reply but no change to current unlimited time for initial presentations. It will go before the NPA’s meeting on 28 March for approval.<br />
13/27P Planting of a Jubilee Oak. Cllr Stokes reported one oak has been planted at Bleak Hill and showed photos. The Clerk will put on the agenda for 26 March to discuss whether a plaque should be funded by the Parish Council.<br />
13/28P Cllr Burtenshaw requested a letter of thanks be sent to Malcolm Lambert, the Clerk now has his address and she will action this on Wednesday 13 March.<br />
5. Public Forum – none.<br />
13/32P<br />
Mr Smith enquired exactly why the application for Land at Mockbeggar is not being discussed at this meeting, the delay in waiting till the next meeting, and how would the Parish Council be able to respond when the deadline has passed. Cllr Spark advised due to errata within the application form, the NPA were seeking clarity and would advise the Parish Council in due course, and an extension could be requested until after the next Planning Committee meeting on 9 April. Mr Smith expressed he is unhappy the agenda states there are errata in the application form when the issue had been cleared up between the agent and the NPA.</p>
<p>Furthermore, Mr Smith expressed concern on why he has not been consulted on the proposed works in the Moyles Court area. The Clerk responded that Cllr Burtenshaw had spoken directly with Mr Smith about the proposals in this area, and whilst the work is scheduled in with the Forestry Commission, it has been a work in progress. Clerk to forward the details to Mr Smith. Cllr Errington advised the works will increase the splay on the entrance to the access gate to Newlands Farm making it easier for farm vehicles to use the entrance.</p>
<p>Mr Smith went on to express his unhappiness at vehicles restricting this access point and after some discussion, along with the Parish Council’s proposal to display a ‘no parking’ sign on the gate with Mr Smith’s permission, it was agreed the Parish Council will request the ice cream van to only park their motorised vehicle in the access point, should they need to park there. Mr Smith was encouraged to report any incidences of his access being blocked to the Clerk, along with photographic evidence. Clerk to liaise with Mr Smith re: no parking sign.</p>
<p>6. Development control and TPO applications.<br />
13/33P<br />
NPA 13/98200 Three Springs, 5 New Road, Mockbeggar – rendering of bungalow. Cllr Richardson explained the location of the bungalow and detailed it is a red brick built residence with several additions over the years. Photos were shown of the right side of the property which is already rendered in white, as is the outbuilding at the end of the garden. Photos were shown of the several extensions to the property with the different colours of brick and mortar. The neighbouring and opposing properties are all rendered white.<br />
Cllr Stokes proposed to recommend permission under option 3, as the neighbouring properties were already rendered in a similar style to that proposed, seconded by Cllr Lane, all in favour (7).<br />
13/34P<br />
NPA CONS/13/0085 Mockbeggar Farm, Mockbeggar – works to ash tree. Cllr Stokes advised the proposed works are to a large ash tree which is clearly visible from Mockbeggar Lane East and Highwood Lane. The tree is on the western perimeter of Mockbeggar Farm; aerial maps were referred to, to establish the location and size of the tree. The proposals for 30-40% reduction were shown on the photos, and concern was expressed on what impact the proposals would have on the amenity value of the tree and on the tree itself. Cllr Stokes had spoken with the NPA tree officer on this application, who indicated she had concerns on the proposals. Cllr Stokes also advised there are large panels of glazing on the winnowing barn to the east of the tree, and expressed concern on the effect of potential light pollution.<br />
Cllr Stokes proposed to raise objections, with a comment that 10% should be the maximum crown reduction. Seconded by Cllr Shand, then voting was not completed due to a comment in relation to 10% crown reduction is difficult to carry out and a councillor thinking the vote was in favour.</p>
<p>Cllr Spark counter proposed to raise objections, expressing concerns on the 40% reduction and defer to the Tree Officer’s recommendation with the comment that the council would accept a 20% reduction overall. Seconded by Cllr Shand, all in favour (7). Motion carried.</p>
<p>13/35P<br />
NPA 13/98213 The Lodge, Moyles Court, Rockford – pitched roof to porch. Cllr Errington explained the location and showed street views and photos of the property and of the flat roof where the proposed works are. Reviewing the elevations, it was determined how the proposed pitch of the new roof would tie in with the existing roof. He confirmed no additional floor space would be gained as a result in this application, and commented his views that the proposal would be an improvement to the existing flat roof. All agreed they had concerns on how the new roof dissects the first floor window.</p>
<p>Cllr Errington proposed to recommend permission under option 1 with delegated powers to the NPA, with the following comments:-</p>
<p>• The Parish Council agree with the principle of the addition of a pitched roof, however would prefer the new roof line to come below the first floor window.<br />

NFDC 13/10140 Drayton Cottage, Linbrook – rear conservatory. Cllr Spark informed that Cllr Errington will act as chair for this application whilst he presents it. Cllr Spark explained the location of this property, and summarised its’ previous planning history. This application is for a conservatory constructed of brick and glass and showed on the elevations it will have views over Linbrook Lake. The NFDC case officer’s comments detailed how a conservatory of a maximum size of 20 sq.m is considered permitted development, and this conservatory is likely to be approx. 20 sq.m. It was discussed and agreed by all that steps need to be taken to help to attenuate the potential light pollution.</p>
<p>Cllr Spark proposed to recommend permission under option 3 with the following comments:-</p>
<p>• The applicant must take steps to help attenuate the potential light pollution with installation of blinds.<br />
• The conservatory is for incidental use only.</p>

Consider Licensing Act 2003 – Grant of Premises License (S17) application for premises: Shell Forest Edge Filling Station A31 Eastbound. Cllr Errington outlined the criteria that EHI PC can respond under, and detailed the current arrangements: the filling station is currently able to sell late night refreshments from 11pm to 5am, however it is not licensed to sell alcohol at anytime. The alcohol license requested is for 24 hours every day.</p>
<p>This was extensively discussed by the Councillors, and it was noted that currently within the Parish there are no 24 hour alcohol licenses in operation, however there is an 8am to 11pm alcohol license. Concerns were raised over the potential for alcohol to be sold and then consumed in the well-screened car park at the soon to be re-opened fast food outlet with restaurant and takeaway immediately next door to the filling station, or at forest car parks a short drive away, especially during the evening and night time hours of the license being operational. It is a rural location hidden from the main access road and its’ main exit is onto the very busy A31 road.</p>
<p>Cllr Spark proposed for the Clerk to write a representation under the concerns of Public Safety and Prevention of Public Nuisance for the following reasons:-</p>
<p>• The fast food outlet immediately next door to the filling station has extensive parking which is well screened from the access road, and use of this parking could result in the alcohol being consumed on someone else’s premises;<br />
• Concerns of public safety on the busy A31;<br />
• The Parish Council desire for the alcohol licensing hours to be restricted to 8am to 11pm, in line with other licenses issued in the area.</p>

Cllr Spark outlined the scheme which is operated by NFDC and enables users to view Ordinance Survey maps with many different layers. It is a very valuable tool, which can assist to establish land ownership and it should be used more by the Parish Council. The subscription cost for the next year is £100. Cllr Spark proposed for EHI PC to pay the subscription for the next year and ensure more members are cross trained on the system. Seconded by Cllr Richardson, all in favour. Clerk to advise NFDC of our participation and put on the agenda for approval on 26 March.</p>

The Clerk had been notified of a consultation on the NPA draft Local Enforcement Plan, which requires a response by 12 Apr (circ.11Mar13). Cllr Lane volunteered to look at this consultation and circulate a proposed response for approval at the next Planning Committee meeting on 9 April.<br />

Cllr Shand commented she finds the drop-box facility very useful. Cllr Errington reminded all users to advise him by email if members are uploading data, to prevent duplication. Everyone was encouraged all to use it when looking at planning applications prior to planning meetings and everyone was reminded not to upload at the last minute.</p>
